HHS Delivers Initial $30 Billion in CARES Act Provider Funding

  • HHS announced delivery of the initial $30 billion in relief funding to providers that is part of the $100 billion relief fund provided for in the CARES Act. Information on provider relief from HHS is found here.

Congressional Outlook

  • Senate Minority Leader Chuck Schumer said today that he continues to speak with Treasury Secretary Steve Mnuchin about an interim spending bill that would provide $250 billion in additional funding for the Paycheck Protection Program. Democrats are holding out for additional hospital funding as well as more money for state and local governments. Sen. Schumer indicated that an agreement is possible early next week.

From the FDA

  • The FDA issued a second emergency use authorization to decontaminate N95 respirators.
  • The FDA authorized a blood purification device to treat COVID-19.
  • The FDA released a temporary policy regarding non-standard PPE practices for sterile compounding by pharmacy compounders not registered as outsourcing facilities during the COVID-19 public health emergency.

OCR Announces Enforcement Discretion at Community-Based Testing Sites

  • The Office for Civil Rights announced it generally will not impose penalties for HIPAA rule violations on health care provider covered entities and their business associates operating COVID-19 community-based testing sites in good faith for the COVID-19 emergency duration.

DOL Issues Enforcement Guidance for Recording COVID-19 Cases

  • Department of Labor’s Occupational Safety and Health Administration (“OSHA”) has issued interim guidance for enforcing OSHA’s recordkeeping requirements (29 CFR Part 1904) as it relates to recording cases of COVID-19.
