COVID-19 Vaccinations—Key Operational and Employment Considerations

Hall Render attorneys Jon Bumgarner, Melissa Markey, Jennifer Skeels, Dana Stutzman and Cara Tolliver discuss key implications of the COVID-19 vaccine in the workplace with respect to both i) important requirements pertinent to provider-vaccine administrators; and ii) crucial employment law considerations. We will walk through the requirements for provider-vaccine administrators, including EUA instructions and the CDC and applicable state vaccination plans, and discuss how informed consent and authorization to release vaccine information might be best addressed. Additionally, recognizing that there is no one-size-fits-all approach to mandatory and discretionary employee COVID-19 vaccination programs, our experienced team will highlight important considerations for each approach for inclusion in a written policy or informational document, including elements related to the vaccine administration process, anti-discrimination laws under Title VII and the ADA and more. Our team also discusses the availability of workers’ compensation and Public Readiness and Emergency Preparedness (“PREP”) Act Immunity to cover employee vaccine-related injuries or illnesses.
